A work injury can leave you unsure whom to contact, how to obtain treatment, or what to do with a denial letter. Khorozian Law Group helps Garfield residents and other Bergen County workers understand their New Jersey workers' compensation options. Attorney Linda Khorozian meets with clients through our office in Englewood Cliffs.
First steps after a workplace injury
Notify your employer about the injury as soon as possible and ask about medical treatment. In New Jersey, the employer or its workers' compensation insurer generally selects the provider for work-related treatment. Keep a record of whom you notified, when you reported the injury, and the instructions you received. The New Jersey Department of Labor's worker FAQs explain these initial steps.
What to bring to a consultation
You do not need a perfectly organized file before calling. Bring the information you already have, including:
- The date of the accident, or when symptoms associated with your work began.
- Your employer's name and a description of your usual job duties.
- Copies of incident reports, photographs, or messages about the injury.
- The insurer's contact information, claim number, and any denial or payment letters.
- Medical reports, appointment notices, and written work restrictions.
- Recent pay records and dates you missed work.
- A short list of questions about treatment, benefits, or returning to work.
This information helps us identify what needs attention and what additional records may be useful. Keep copies of documents you send to an employer or insurer.
If treatment or benefits are disputed
A denial does not necessarily settle whether you qualify for benefits. New Jersey allows a worker who disagrees with the insurer's determination to seek review through the Division of Workers' Compensation, including an informal hearing application or a formal claim petition. The appropriate approach depends on the dispute and the facts. We can review the insurer's stated reason and discuss your next steps.
Understanding the benefits being discussed
Workers' compensation can include medical treatment, temporary wage-replacement benefits, and benefits for permanent disability when the legal requirements are met. These are different parts of a claim, and a problem with one does not answer every question about the others. Our workers' compensation page and frequently asked questions provide additional background.
